Abstract

Discourse and negotiation procedures serve to broaden political participation and to enhance the quality of political deliberation. This book approaches these practices from the perspective of political legitimacy. In order to derive theoretically sound democratic standards for discourse and negotiation procedures, the underlying concept of 'deliberative democracy' is discussed in both its discourse theoretical (Habermas) and its liberal variant (Rawls). Against this background the multiplicity of practically applied participatory methods is systematised and the features that distinguish them from other forms of political communication are analysed. A stock-taking of reasons given for more participation in current theoretical debates on the state and state-society relations is complemented by an examination of objections against participation, especially from the realm of Luhmann-style system theory. Pros and Cons are then contextualised within the wider debate on governance, i.e. new forms of political control and societal self-control. As a case study the mediation procedure on 'health rooms' for hygienic drug consumption in the surroundings of the main railway station of the city of Hamburg, Germany is evaluated to assess possible achievements and limits of discursive participation and the impact of such procedures on the German political system. Diskurs- und Verhandlungsverfahren dienen der breiteren politischen Beteiligung und einer erhöhten Qualität der politischen Beratung. Das zugrunde liegende Konzept 'deliberativer Demokratie' wird in seiner diskurstheoretischen (Habermas) wie in seiner liberalen Variante (Rawls) entfaltet, um demokratietheoretische Leistungsanforderungen an Diskurs- und Verhandlungsverfahren präzise abzuleiten. Vor diesem Hintergrund wird die Vielfalt praktisch erprobter Beteiligungsverfahren systematisiert und gegen andere Formen politischer Kommunikation abgegrenzt. Einer Bestandsaufnahme der staats- und gesellschaftstheoretischen Begründungen für mehr partizipative Deliberation folgt die Auseinandersetzung mit vor allem systemtheoretischen Einwänden (Luhmann) und eine Einbettung in die Debatte um neue Formen politischer Steuerung und gesellschaftlicher Selbststeuerung. Als Fallbeispiel dient das Mediationsverfahren zur Frage weiterer Gesundheitsräume im Umfeld des Hamburger Hauptbahnhofs, um mögliche Leistungen und Grenzen diskursiver Partizipation und deren Auswirkungen auf das politische System der Bundesrepublik abzuschätzen.
