Abstract
When a suspect enters the realm of the criminal process – whether detained in police custody or subject to a voluntary interview – they may be considered vulnerable. Suspects with certain characteristics or conditions – such as young age, and intellectual and psychosocial disability – may have a heightened vulnerability when in custody, as has been acknowledged across many European jurisdictions and by the Council of Europe and the European Union. Problems remain, however, with how vulnerability is defined in law and in practice. This chapter considers the definition of vulnerability across numerous sources and from various perspectives. Drawing on lessons from England and Wales, where the definition of vulnerability and the safeguards surrounding vulnerable suspects have been in force since the mid-1980s, this chapter urges that more work is done to – accurately and adequately – define vulnerability and provide support to vulnerable suspects. In doing so, it further argues that law and regulation in Ireland should acknowledge a holistic approach to the vulnerability of suspects.
