Abstract
There have long been calls in England and Wales for the reform of the law regulating the financial consequences of the breakdown of cohabiting relationships. With reference to a new conceptual framework for the legal recognition of adult relationships, this chapter will argue that such a reform is both necessary and overdue, but that function-based frameworks of legal recognition pose particular challenges of definition that require careful consideration. It will be argued that marriage-like definitions are best avoided because they are inherently problematic and instead a flexible definition that takes into account the variety of cohabiting relationships ought to be developed.
