Abstract
Historically, the principal division in the law of the sea has been between the territorial seas, which form part of the territory of a State but within which other States enjoy some restricted rights, and the high seas which are open for all. This has now changed with the development of new zones of functional and resource-oriented jurisdiction, accompanied by complex realignments of jurisdictional competences cutting across and redefining the traditional approach. This chapter traces these developments, introducing the principal zones of maritime jurisdiction, examining rules concerning baseline construction—which is foundational to the entire subject—and outlining problems concerning the delimitation of overlapping maritime entitlements.
