Abstract
This, the second part of a two-part article, contrasts negative perceptions of the personal injury system, contributing to the view that the tort has encouraged a damaging compensation culture, with its operation in practice. Presents data on the trends in various types of personal injury compensation claims between 1973-2012 to assess the effect of conditional fee agreement funding and advertising by law firms and claims management companies. Considers why only road traffic accident claims have seen a significant increase.
