Abstract
Discusses the ECtHR ruling in Delfi AS v Estonia (64569/09) on the extent to which third party operators could be liable where they inadvertently allowed libellous, offensive or threatening statements to be disseminated via the internet. Considers whether an internet news portal was the publisher of unscreened public comments displayed on the website and whether interference with its rights under ECHR art.10 was prescribed by law and necessary in a democratic society.
