Abstract

ABSTRACT On the 21 February 2001, Nigeria and Sao Tome & Principe entered into a Treaty on the Joint Development of Petroleum and other Resources in respect of Areas of the Exclusive Economic Zone of the Two States, which entered into force on 16 January 2003. This chapter explores the relevant domestic Nigeria legislative framework that would affect the implementation of the Joint Development Agreement (JDA) in Nigeria. It further examines briefly the so-called Special Regime Area under the Treaty. Additionally, the chapter provides an overview of some key provisions of the Treaty, exploring both its legal form and status, and seeks to determine whether it may be subsumed within any of the JDA models that may be discerned from existing State Practices. Furthermore, it explores the dispute settlement provisions in the JDA. Besides, the chapter assesses if there have been successes in achieving the goals of the JDA and possible challenges currently arising in the implementation of the treaty.
