Abstract

In Re G (Children) (Residence: Same-sex Partner), the House of Lords reversed a Court of Appeal decision to transfer the residence of two children from their biological mother to her former lesbian partner, who had co-parented the children from the time of their births. Historically, there has been a remarkable paucity of reported cases on the subject of lesbian parenting and Re G is particularly noteworthy for being the first such case to reach the House of Lords. It is somewhat surprising, therefore, that the House of Lords refuted the significance of the fact that this case involved a dispute between lesbian parents and declined to grasp the opportunity to reflect on the legal approach to lesbian parenting. Instead, Baroness Hale’s leading judgment focused on ‘principles which are of universal application’ in the resolution of residence disputes (para 44).
