Abstract

Analyses how the repeal of EU legislation may affect the protection of vested rights under English law. Examines the English rules of ratione temporis applicable to statutory repeals, the savings provision of the Interpretation Act 1978 s.16(1) and the rules on re-enactments under s.17 of the Act. Discusses how the route by which an EU instrument became part of English law affects the consequences of its repeal. Considers the general principles of EU law that may save a repealed EU instrument.
