Abstract
Discusses the impact of the UK having opted into Regulation 4/2009 (Maintenance Regulation) on applications, under the Matrimonial and Family Proceedings Act 1984, for a pension sharing order in respect of a UK pension by individuals who divorced abroad. Explains the three stage process for applications for financial relief under s.12 of the 1984 Act. Considers the meaning of maintenance and whether pensions fall within its scope. Outlines provisions on jurisdiction in the Regulation. Identifies the practical application of the Regulation, including the implications for premarital agreements.
