Abstract

This, the first part of a two-part article on landowners' responsibilities for remediating contaminated land under EU and national law, focuses on the liability of waste producers and holders under Directive 2008/98 (Waste Framework Directive), and the relationship with the liability to prevent and remediate contaminated land under Directive 2004/35 (Environmental Liability Directive). Considers the resolution of clashes between the Directives.
