Abstract
The article analyses some theoretical ideas of European constitutional pluralism influenced by Ehrlich's sociology of law. After the introductory analysis of the concept of EU constitutional pluralism and critique of its positivist understanding, the article focuses on theory of societal constitutionalism, normative plurality and heterarchies prevailing over the normative hierarchical concept of law. While more conventional legal theories frame these heterarchies and pluralism of transnational constitutionalism by monist approaches, theory of societal constitutionalism radicalises these heterarchies and considers the transnational system of law one of many societal systems of functionally differentiated global society. The importance of Erhlich's sociology of law consists of its capacity to analyse this differentiated system of law which functions independently of state organisation with its monopoly of political power in both supranational EU law and transnational global law. The concluding part, therefore, focuses on Teubner's theory of societal constitutionalism which draws on Ehrlich's sociological notion of law in the most original way, analyses knowledge regimes as new constitutional subjects and understands them as a new constellation of relationships between social power and constitutional authority stretching beyond classic constructs of constitutional theory and cosmopolitan ethics as legitimation forces of global law and politics.
