Abstract
This paper reviews the emerging international and domestic recognition of the right to independent living and its potential impact on disabled people in Europe. The analysis commences with a brief overview of the UN Convention on the Rights of Persons with Disabilities, of which independent living is both a central theme and a specific provision. The paper then considers the nature of the right to "independent living" and its recognition in other international and national provisions. It argues that there is an emerging European consensus that such a right already exists and that, in consequence, the Disability Rights Convention is likely to have a significant impact on the community living and deinstitutionalisation movements.
