Abstract
This paper provides a brief discussion of the recent guidance issued by the GMC concerning confidentiality and the disclosure of confidential information. The new guidance explicitly addresses scenarios that doctors may encounter, offering greater detail than was offered previously on when it is ethical to disclose confidential information and when there is a professional ethical duty to do so. The focus will be on those parts of the guidance which cover disclosures made without consent. These changes and developments may have important ramifications for patients, doctors, their relationship and doctors’ relationship with other professions and the State. It is argued that while these changes do not directly modify the law, the changes that they create warrant greater public consultation.
