Abstract
Comments on the collapse of the Equitable Life litigation against the company's auditors, executive directors and non-executive directors. Reviews the background to the litigation, including the House of Lords ruling in Equitable Life Assurance Society v Hyman on the invalidity of a differential terms bonus scheme. Highlights the duties owed to companies by non-executive directors, confusion over their role and the extent of their potential liabilities.
