Abstract

Examines the findings from research commissioned by the Department of Constitutional Affairs on litigants in person, considering whether there has been a rise in the number of unrepresented litigants and vexatious litigants in county and family courts and the High Court and the reasons for litigants to represent themselves. Outlines the problems caused to the court by litigants in person, assesses whether they tend to be claimants or defendants and questions the advice available to such litigants. Concludes on whether litigants in person are disadvantaged.
