Abstract

The Court of Justice accepts that cost ceilings are permissible under Article 14 of the Enforcement Directive (2004/48/EC), but does so on certain conditions as to how those ceilings are set. It also confirms that the recovery of the cost of technical advisers (experts) should not be restricted to where there is fault.
