Abstract

The doctrine of qiṣāṣ — retaliation in kind for intentional homicide — holds a central place in Islamic criminal jurisprudence (fiqh al-jināyāt). It represents both a moral and legal balance, merging divine justice with human mercy by giving the victim’s heirs the choice between retribution (qiṣāṣ) and compensation (diyyah).
